Pension transfer advice ban in the UK

The UK FCA banned Daniel Thomas and fined him £742,700 after finding he recklessly gave defined benefit pension transfer advice without being qualified or authorised to give it. The action is an individual enforcement outcome, not a new rule. Our read: firms offering pension transfer advice should confirm adviser authorisation and controls before client-facing work.

Form PF reporting deadline moves further

The CFTC and SEC further extended the compliance date for the Form PF amendments adopted on February 8, 2024, from October 1, 2026 to July 1, 2027. This applies to all Form PF filers and large hedge fund advisers, i.e. certain SEC-registered investment advisers to private funds, including those registered with the CFTC as a commodity pool operator (CPO) or a commodity trading adviser (CTA). This is a further extension of an already adopted reporting requirement, not a new Form PF regime. Our read: firms inside the Form PF perimeter should update reporting calendars and implementation plans to July 1, 2027.

US market mechanics and clearing changes

The SEC gave immediate effectiveness to NYSE LLC’s proposed change to NYSE Rule 7.18 on trading halt procedures. NYSE Arca’s modification to the Options Fee Schedule, covering fees and rebates for manual options transactions, is also effective immediately. CME Securities Clearing has filed a proposed rule change to amend Rule 410, Rule 101, the Capped Liquidity Facility Procedure, and the Liquidity Risk Management Policy, but that filing is a proposed rule change, not an adopted rule. A separate SEC notice also seeks comment on a request to exempt certain provisions of the National Market System Plan Governing the Consolidated Audit Trail (CAT) related to the recovery of costs incurred during Period 4 of the Financial Accountability Milestones. Our read: firms using NYSE halt procedures or NYSE Arca manual options trading should check operations now, while the CME and CAT items remain at proposed or comment stage.
